| Summary of the Program |
The law prohibits U.S. employers from "knowingly" employing workers with knowledge that they are not authorized to work in the United States. Under government regulations, "Knowingly" includes constructive knowledge, such as receiving an SSN No-Match letter from the Social Security Administration. In this program, you will learn what the law and policy say about SSN No-Match letters, the 2007 Department of Homeland Security's (DHS) SSN No-Match letters regulation that the court put on hold, about a new regulation DHS promulgated in 2008 in its place, and about the safe-harbor provisions in the DHS Regulations. You will learn how to include SSN No-Match procedures in your Employer Immigration Compliance Plan, and how to establish no-match policy and procedures that comply with immigration law, while not violating anti-discrimination laws and policies. |
