ICE Announces I-9 Audit of 652 Business' Employment Records |

Immigration and Customs Enforcement (ICE) announced that it is beginning an initiative to increase their I-9 audit efforts. ICE issued a Notice of Inspection (NOI) to 652 business across the country, and e-mailed Congressmen that they planned to launch I-9 audits in all 50 states.
As part of the I-9 audit initiative, American Apparel, a clothing manufacturer based in Los Angeles, had their I-9s audited by ICE. ICE determined that it believes 1,600 workers appear to be unauthorized. This would comprise about one-third of American Apparel's workforce. The company announced that if the workers cannot produce proper documentation that they will be terminated. No criminal or civil charges have been filed against American Apparel at this time.
This trend will continue in the future. I-9 audits will likely become similar to IRS audits, with both random and targeted audits against employers. It is becoming increasingly important for companies to properly complete their I-9s and adopt strong immigration compliance procedures, including annual I-9 audits.
